Chengs Enterprises, Inc. ("we," "us," or "our") operates the Easy USA Wholesale online store at easyusa.com and its associated brands, including Easy USA and Wave (together, the "Services"). We are a U.S.-based wholesale footwear distributor headquartered at 68 Broad St., Carlstadt, NJ 07072. Our online store is powered by Shopify.

This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit our website, apply for a wholesale account, create an account, place an order, or otherwise interact with us. It applies to all visitors, customers, and wholesale account holders. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to personal information.

"Personal information" means information that identifies, or can reasonably be linked to, you or another person. It does not include information that has been de-identified or aggregated so that it can no longer reasonably identify you.

3. Information We Collect

3.1 Account and Order Information

An account is required to place an order on our website. When you create an account or place an order, we collect:

• Name, email address, and phone number
• Billing and shipping addresses
• Company name and business contact details
• Order history, items viewed, added to cart, or purchased, and order notes or comments you provide
• Account login information and preferences

3.2 Wholesale Account Applications

When you apply for or maintain a wholesale account, we also collect:

• Business name, business type, website, phone number, and business address
• Tax identification number and/or resale certificate number
• Resale certificate documents you upload (optional)
• Any notes you include with your application
• Purchase order numbers and other documentation needed to verify eligibility, apply tax exemptions, and maintain your account

3.3 Payment Information

Payments are processed by Shopify Payments and the payment methods offered at checkout, such as Shop Pay, Apple Pay, and Google Pay. Card and payment details are handled by these PCI-compliant payment processors. We do not store full card numbers on our own systems.

3.4 Saved Items and Stock Alerts

If you save products to your favorites or sign up to be notified when an item is back in stock, we collect the items you select and your email address.

3.5 Communications

When you contact us by email, phone, contact form, or our website chat, we keep records of that correspondence, including your name, contact details, company, and the content of your message. Our website chat is provided by Shopify Inbox and may be answered by an AI shopping assistant provided by Shopify, which uses your messages and the pages you are viewing to respond. Chat conversations are stored by Shopify and may be reviewed by our staff.

3.6 Information Collected Automatically

When you visit our website, we and our service providers automatically collect:

• IP address and approximate location
• Browser type, device type, and operating system
• Pages visited, time spent, referring URLs, and search terms
• Clicks, scrolling, mouse movements, and other interactions with our pages (see Section 6)

This information is collected through cookies, pixels, and similar technologies described in Section 6.

3.7 Sources of Information

We collect personal information directly from you, automatically through your use of the Services, from our service providers (such as Shopify and our payment processors), and from marketing and advertising partners.

• Wholesale administration: reviewing applications, verifying eligibility, applying tax exemptions, and managing wholesale pricing and your account

• Marketing: sending promotional emails to people who have opted in, and showing and measuring online advertising (see Sections 6 and 8)

5. Customer Accounts

Customer accounts are powered by Shopify, and an account is required to check out. With an account you can view your order history, save addresses, and save favorites. Wholesale pricing is shown only to approved wholesale accounts. Saved payment methods, where offered (for example through Shop Pay), are stored by our payment providers under their own terms and privacy policies, not on our own systems.

6. Cookies and Tracking Technologies

Our website uses cookies, pixels, and similar technologies in the following categories:

• Strictly necessary: required for your cart, checkout, login, and security. These cannot be disabled without affecting the website.
• Preferences: remember your settings, such as accessibility settings.
• Analytics: help us understand how visitors use our website. We use Google Analytics 4 (through the Google tag) and Microsoft Clarity. Microsoft Clarity records how visitors interact with our pages (such as clicks, scrolling, and mouse movement) to create heatmaps and session replays. Clarity is configured to mask text you type into form fields.
• Marketing and advertising: measure our advertising and show relevant ads, including through Google Ads conversion tracking and our email marketing provider's website tracking.

You can control cookies through your browser settings. You can opt out of Google Analytics with the Google Analytics Opt-out Browser Add-on, and learn how Microsoft uses data at the Microsoft Privacy Statement. Disabling some cookies may affect how the website works. Cookies may change as our website and service providers are updated, so we do not list every individual cookie.

• Shopify: website hosting, customer accounts, checkout, and e-commerce infrastructure
• Shopify Payments, Shop Pay, Apple Pay, Google Pay: payment processing
• Shopify Inbox: website chat, including AI-assisted responses provided by Shopify
• Google tag / Google Analytics 4: website analytics
• Google Ads: advertising and conversion measurement
• Microsoft Clarity: website analytics, heatmaps, and session replay
• Mailchimp: email marketing and newsletter sign-ups
• hCaptcha: spam and bot protection on website forms
• UserWay: website accessibility tools
• Cloud hosting providers: hosting for our wholesale application, favorites, and back-in-stock alert features
• UPS and freight carriers: shipping and delivery

We may also use other Shopify apps and service providers as needed to operate our website and fulfill orders. Our service providers may use your information only as needed to perform services for us, except where a provider acts under its own privacy policy as described in Section 11.

8. Marketing Communications

We send marketing emails only to people who have opted in. You can unsubscribe at any time using the link in any marketing email or by emailing contact@chengsinc.com. Opting out does not stop transactional messages about your orders or account.

9. Shipping and Delivery

We ship only within the United States. Our primary carrier is UPS. For larger or freight shipments, delivery may be arranged with you before payment and shipment. We also offer local delivery by our own staff for eligible orders. We share your name, shipping address, and contact details with carriers and logistics providers as needed to deliver your order.

We share personal information only in these circumstances:

• Service providers: companies that perform services for us, including payment processing, hosting, analytics, customer support, email, security, and shipping (see Section 7)
• Advertising and marketing partners: such as Google and Mailchimp, to measure and deliver advertising and marketing (see Section 13)
• Shopify: as described in Section 11
• Affiliates: companies within our corporate group
• Professional advisors: attorneys, accountants, auditors, and insurers
• Business transfers: in connection with a merger, acquisition, financing, sale of assets, or bankruptcy
• Legal and safety: when required by law, subpoena, court order, or other legal process, or to protect our rights, our customers, or others

We do not sell your personal information for money. Some of the advertising and analytics sharing described above may be considered a "sale" or "sharing" of personal information, or "targeted advertising," under certain state privacy laws. See Section 13 for how to opt out.

11. Relationship with Shopify

Our website is hosted by Shopify, which collects and processes personal information about your use of the Services to provide and improve them. We also use certain Shopify features that combine information about your interactions with our store with information from other merchants and from Shopify. For those features, Shopify is responsible for processing your personal information, including responding to requests to exercise your rights. 12. Data Retention and Security

We keep personal information for as long as needed for the purposes in this Privacy Policy, including to maintain your account, meet tax and accounting obligations (for example, keeping resale certificates and tax-exemption records for the periods required by law), resolve disputes, and enforce our agreements. When information is no longer needed, we take reasonable steps to delete or de-identify it.

We use commercially reasonable technical and organizational safeguards, including encrypted (SSL/TLS) data transmission, access controls, and reputable service providers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please do not send sensitive information, such as full tax documents, over unsecured channels like regular email when our secure upload form is available. You are responsible for keeping your account login details confidential.

13. Your Rights and Choices

Depending on where you live, you may have the right to:

• Access / know the personal information we hold about you
• Correct inaccurate personal information
• Delete your personal information, subject to legal exceptions
• Portability: receive a copy of your personal information in a usable format
• Opt out of the "sale" or "sharing" of your personal information, and of targeted advertising
• Opt out of marketing emails at any time

If your browser sends a Global Privacy Control (GPC) signal, we treat it as an opt-out request for that browser, and for your account if we can associate the signal with it. We will verify your identity before completing certain requests and respond within the time required by applicable law. You may use an authorized agent to make a request for you. We will ask the agent for proof of your permission and may ask you to verify your identity directly.

Appeals: if we decline your request, you may appeal by replying to our decision or emailing contact@chengsinc.com with "Privacy Appeal" in the subject line. If you are not satisfied with our response to your appeal, you may contact your state attorney general.

Non-discrimination: we will not discriminate against you for exercising your privacy rights.

14. State Privacy Rights

California residents: under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, you have the rights listed in Section 13. In the past 12 months we collected the categories of personal information described in Section 3, from the sources in Section 3.7, for the purposes in Section 4, and disclosed them to the categories of recipients in Sections 7 and 10. Identifiers and internet activity information may have been "sold" or "shared" with advertising and analytics partners for cross-context behavioral advertising. We collect tax identification numbers only to verify wholesale eligibility and tax exemptions, and we do not use or disclose them for any other purpose. These rights apply to information about business contacts as well as individual consumers.

Other states: residents of other states with consumer privacy laws, including Virginia, Colorado, Connecticut, Texas, Oregon, New Jersey, and others, may have similar rights to access, correct, delete, and obtain a copy of their personal information, and to opt out of targeted advertising and sales. Use the methods in Section 13 to exercise them.

15. Children's Privacy

Our website is intended for businesses and adults and is not directed to children. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share the personal information of anyone under 16. If you believe a child has given us personal information, contact us at contact@chengsinc.com and we will delete it.

16. International Visitors

We operate in the United States and ship only within the United States. If you access our website from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country.

Our website links to third-party websites and services, such as our storefront on Faire and our social media pages. We are not responsible for their privacy practices. Please review their privacy policies before providing information to them.

We may update this Privacy Policy to reflect changes in our practices, technologies, or legal requirements. When we do, we will post the revised policy here and update the "Last Updated" date above, and provide any additional notice required by law.
